I understand you are experiencing issues with your A38. Here are a few steps you can take to attempt to remedy the issues.
Hard reset the A38 by pressing and holding the multi-function button then pressing and holding the up volume button. Do this until the device shuts off.
Re-pair the A38 to the device.
Ensure the mute on the bottom of the left ear is off(no orange is showing means the mute is off)
